A More Balanced View of Syngenta

This article not only explains the basic issues of the Syngenta case better than I did yesterday, but it also presents a more balanced view of what happened. Rather than poor advocacy, they suggest that the Justices were just extremely unsympathetic to Petitioner's argument.

One wonders, if the Justices didn't think there was anything to argue, why they granted cert in the first place. Some circuits had adopted use of the All Writs Act for removal, but it still doesn't seem to justify hearing arguments.
