Caballes Transcript

The transcript [505k PDF] from the oral arguments in Illinois v. Caballes was released last week. If you've followed the case at all, either on your own or here, it's a good read. My furious note scribbling turned out to cover a lot of the major points well, but not everything. There are three areas my coverage was lacking. First, I significantly underrepresented Justice O'Connor's participation in the oral argument. Second, I missed a lot of the action when the U.S. was arguing as amicus. Finally, I missed one of the three points in Illinois' rebuttal. I had it in my notes, but by the time I got to the end of typing up my notes, I didn't understand what I had written, so I left it out. I'm not a paid journalist and I don't take good shorthand, so what can you do?

I'm considering camping out with some friends next week to hear the arguments in the wine cases. If I make it, I'll post a similar pseudo-transcript.

What's this about cases on wine? I'm unemployed...I've got time if you need a camping buddy.

The court is going to consider whether the Commerce Clause and the 21st Amendment allow states to prohibit interstate wine shipments. If you order from Wine.com, you can't have your package sent to certain states because of these laws. The laws favor local wine sellers and distributors over consumers and small producers.
